Frequently asked questions

What must a DMCA notice include?

Under 17 U.S.C. § 512(c)(3): identification of the copyrighted work, identification of the infringing material and its location, your contact information, a good-faith statement, a statement that the notice is accurate and, under penalty of perjury, that you are authorised to act, and your signature.

Does the DMCA apply in Europe?

The DMCA is US law, but most global platforms accept DMCA-format notices. In the EU, the Digital Services Act (Article 16) requires hosting services to accept notices with a similar set of elements. Choose the EU format for EU-based hosts.

Can I use a DMCA notice for trademark infringement?

No. The DMCA only covers copyright. Use it for copied photos, text, and video. For misuse of your brand name or logo, send a trademark complaint or use our Cease & Desist Letter Generator.

Is this legal advice?

No. This generator produces a template based on the statutory requirements. Have counsel review notices in contested or high-value cases, and never send a notice you do not believe in good faith.
